To utilize certain Partner Benefits, you may need to pay fees as set by our Partners which may include, but not limited to activation fees, monthly fees, subscription fees, and/or surcharges, which shall be payable directly to our Partners.
In some circumstances you may be required to attend and utilize the Partner’s facilities, and/or purchase the Partner’s goods and/or services for a specified minimum number of times in order to enjoy the Partner’s Benefits. Our Partner may refuse to proceed with redeeming the Partner Benefit should you fail to meet these requirements.

Partner Benefits are provided by our Partners. These Partners are separate and independent entities, and PT AIA FINANCIAL shall not be responsible for the products or services provided by such Partners. The products and services offered by our Partners are not sold or marketed by PT AIA FINANCIAL, and the provision of the such products and services shall be subject to terms and conditions of our Partners. Our Partners may apply additional terms and conditions with regards to the availability and eligibility of earning Vitality Points and/or the Partner Benefits.
PT AIA FINANCIAL makes no representations or warranties, express or implied, of any kind with respect to any Partner Benefits, including price, availability, quantity, quality, accuracy, timeliness, usefulness, merchantability or fitness of any product or service provided as part of the Partner Benefits, including without limitation, success rate, fitness for a particular purpose and quality.
PT AIA FINANCIAL will not be liable for any loss, injury, claim or damage suffered or incurred as a direct or indirect result of the Member’s use of a product or service or from Partners. PT AIA FINANCIAL shall not be liable for Partner withdrawal from the Vitality Programme or for Partner changes, cancellations and/or Vitality Point accrual caused by Partner withdrawals from the Vitality Programme for any reason.
Any dispute about any products or services provided by our Partner in relation to the Partner Benefits, must be resolved directly with the relevant Partner.
By joining and participating in the Vitality Programme, you acknowledge that you may be required to directly provide your consent and personal data, such as your name, address and certain other personal data of yours to our Partners. You also acknowledge that by providing your consent and personal data directly to our Partners, you may receive promotional materials, mailings or emails from our Partners with respect to the Partner’s products and services.
You are solely responsible for the personal data that you share directly to Partner.

A Partner (solely or jointly with PT AIA FINANCIAL) may issue Benefit Guides which sets out the rules governing the use and access to the Partner Benefit.
Vitality Program Benefit Guides are based on information received by us from our Partners. PT AIA FINANCIAL will not be liable for any loss, injury, claim or damage suffered or incurred by you in reliance of the information contained in the Vitality Program Benefit Guides written based on information obtained from Partners.
All information in Vitality Programme Benefits Guide and other information provided for any benefit is general information only and is not in any way intended to be financial, medical, nutritional, health, fitness, legal, or other advice or as a substitute for such advice. Any such information is not provided to influence you to acquire any product or service.
Vitality Programme Benefit Guide and other information provided in respect of Partner Benefits do not take into account your personal circumstances. You should obtain professional advice from a medical practitioner, pharmacist, dentist, nutritionist or other appropriate health professionals in relation to your own personal circumstances or in relation to the diagnosis or treatment of any medical condition. If necessary, you should consult with a professional. Importantly, the results of any benefits, devices, services, software available, assessments, health checks, consultations or tools cannot replace any advice a doctor or other health professional gives. You should not change or discontinue any assistance or treatment you may be receiving on the basis of information provided in relation to any benefits, devices, services, software available, assessments, health checks, consultations or tools accessed or used without first consulting your healthcare provider. Medicines you use for your physical or mental health may also affect the results of any benefits, devices, services, software available, assessments, health checks, consultations or tools accessed or used. You should also seek professional advice immediately should any symptoms you may be experiencing persist or worsen.

Description
By taking part in the Vitality Programme fitness assessment with a Vitality Programme gym Partner (and/or its franchisees) and/or by using the Vitality Programme gym Partner’s and/or its franchisee’s services and/or facilities (“Activity”) you:
A. authorize, agree and consent to PT AIA FINANCIAL collecting, using (including handling and storing) and/or disclosing personal data and other personal information including Vitality Data to our Partners in connection with the Activity or the Vitality Programme in accordance with the applicable Vitality Programme Privacy Statement available on the AIA Vitality App;
B. authorize, agree and consent to the relevant gym Partner collecting, using (including handling and storing) and/or disclosing personal data and other personal information including Vitality Data in connection with the Activity only for Vitality Programme purposes in accordance with its Privacy Policy available on the Partner’s website and in the absence of such a provision, in all cases to PT AIA FINANCIAL;
C. represent that you are in good physical and mental condition and have no pre-existing or existing health and medical conditions, impairment or disability that might prevent you from undertaking the Activity. You agree and acknowledge that neither PT AIA FINANCIAL nor the gym Partner is in a qualified position to provide you with medical advice related to your physical condition and/or inability to undertake the Activity;
D. agree to obtain professional advice from a medical practitioner, pharmacist, nutritionist or other appropriate health professionals in relation to your own personal circumstances or in relation to the diagnosis or treatment of any health / medical condition. If necessary, you agree that you will regularly consult with such a professional. You also agree to seek professional advice immediately should any symptoms you may be experiencing persist or change;
E. acknowledge and agree that the results of the Activity are not a substitute for medical advice or treatment and must not be used for diagnosing or treating a health problem or to replace your doctor or healthcare professional. You agree not to change or discontinue any assistance, medication or treatment you may be receiving on the basis of information provided in relation to the Activity without first consulting your doctor or health professional. Medicines you use for your physical or mental health may affect the results of the Activity. Any reliance by you on the information provided in undertaking the Activity will be at your own risk. PT AIA FINANCIAL and the gym Partner make no express or implied representation or warranty regarding the completeness, accuracy, reliability or currency of the information or results provided; and
F. acknowledge and agree that PT AIA FINANCIAL and the relevant gym Partner exclude all liability under contract, tort, statute, equity or in any other manner, for any injury (including without limitation death, personal, bodily or mental injury), damage or loss of any kind whatsoever (including without limitation, any liability for direct, indirect, special or consequential loss or damage) sustained by you or any other person, or for any costs, charges or expenses incurred by you or any other person arising from or in connection with the Activity and/or any act or omission of PT AIA FINANCIAL and/or the relevant gym Partner, except to the extent that such injury, damage or loss is caused by the gross negligence of PT AIA FINANCIAL and/or the relevant gym Partner. In such circumstances, the liability of the respective party will be limited to the injury, damage or loss directly caused by that party’s gross negligence. This section does not exclude or intend to exclude, any consumer guarantees applicable to the Activity.

Use of your Fitness Tracking Device as part of the Vitality Programme

You may use a Fitness Tracking Device to participate in the Vitality Programme and can use more than one Fitness Tracking Device. However, we will only count one Fitness Tracking Device for each activity at any time for awarding Vitality Points or Partner Benefits with the Vitality Programme.
You will need to synchronize your Fitness Tracking Device with the Vitality Programme at least on a weekly basis for you be able to participate in a weekly challenge. It is your responsibility to ensure the data collected by the Fitness Tracking Device accurately reflects your activity levels and are reported correctly to the Vitality Programme. For the purposes of the Vitality Programme and achieving the health and fitness targets, your Fitness Tracking Device must be for your own use and must not be worn by anyone else other than yourself during any activity which you will be awarded Vitality Points for.

We do not accept responsibility:
(i) for your purchase and use of your Fitness Tracking Device with the Vitality Programme;
(ii) if your Fitness Tracking Device is not operational or if you are not able to operate them for the purposes of the Vitality Programme; and/or
(iii) for damage to your Fitness Tracking Device, whether the damage arises in connection with the Vitality Programme, and costs associated with their repair or replacement. It is your responsibility if your Fitness Tracking Device needs repair or replacement.
You authorize Vitality Programme and its service providers to use, collect and/or access your Vitality Data from your Fitness Tracking Device or through your Fitness Tracking Device manufacturer or other third parties engaged in connection with the Vitality Programme.

Your default Vitality Status will be Bronze. Points earned and accumulated throughout your Vitality Programme Membership Year are added towards your Status. The more Vitality Points you earn, the higher the Vitality Status you will achieve. The different Status levels are: Bronze, Silver, Gold and Platinum. To move up a Status, you will need to accumulate a sufficient number of Vitality Points to reach the relevant Status. The table below sets out how many Vitality Points are needed for each Vitality Status.

Your Vitality Status that you achieve by end of the year of the Vitality Programme will determine the Partner Benefits and/or the Programme Benefits for your Vitality Integrated Policy which you may be entitled for the following year. If you obtained a higher Vitality Status in the current year, you may be eligible to the corresponding Partner Benefits in the same year.
As your Vitality Status changes, the Programme Benefits and/or the Partner Benefits you may entitled to and the terms relating to those benefits may correspondingly change. Please refer to Vitality Programme Provision and Vitality Programme Benefit Guides for further information

Earning Vitality Points

You will earn Vitality Points for completing certain activities and assessments as required on the AIA Vitality App. Additional rules such as age and gender rules apply to some activities. Please refer to the criteria for these activities on the AIA Vitality App for further details. The number of Vitality Points you can earn will depend on a range of factors such as the activity you are doing and your health goals and risk factors. We may adjust the number of Vitality Points you can earn for each activity depending on your individual health status or how important the activity is to your health status. Certain activities and/or groups/ categories of activities may have limits as to how many Vitality Points you can earn over a certain time period. Additional terms and conditions may apply to each activity. Please refer to the AIA Vitality App for further details.

Awarding of Vitality Points

Vitality Points will be awarded to you in accordance with the Terms and Conditions and as determined by us and our respective Partners from time to time. In some cases, it may take approximately 30 (thirty) days for your Vitality Points to be reflected in the AIA Vitality App. We assume no control, responsibility or liability as to the awarding of or any delay in the awarding of Vitality Points or posting of transactions into your Vitality Programme membership account by our respective Partners.
PT AIA FINANCIAL and its Partners may run promotions from time to time and offer bonus Vitality Points. Qualification for these bonus Vitality Points shall be subject to the terms and conditions of each individual promotion. Where a promotion requires pre-registration, bonus Vitality Points will only be credited if Members complete the pre-registration process on the AIA Vitality App, our official website, or other designated website which may be used in conjunction with the promotion.
PT AIA FINANCIAL and its Partners may exclude specific activities from the crediting of Vitality Points with notice to Members. In some cases, Vitality Points may not be earned in conjunction with other promotions or discounts offered by PT AIA FINANCIAL and/or its Partners. You are advised to check with us and/or our Partners in case of any queries on such promotions or discounts.
It is your responsibility to check that all of your Vitality Points are reflected accurately in the AIA Vitality App.
PT AIA FINANCIAL reserves the right to audit any and all your activities to ensure compliance with the Terms and Conditions and other applicable rules, regulations, policies or procedures relating to the Vitality Programme, without notice to you. During the course of the audit or investigation, we may share your account information with our Partners and also third parties with whom we have contracted to assist in performing such an audit or investigation. In the event that an audit or investigation reveals discrepancies or possible violations, we may delay the processing of the awarding of Vitality Points, cancel any outstanding Partner Benefits redemptions, without statements or suspend your account pending completion of an audit. Upon completion of an audit, if discrepancy or violation has been determined by us, in addition to any other remedies we may have, the Vitality Points may be revoked from your account and/or your Vitality Status may be downgraded to remedy any such discrepancy or violation with or without notice to you.
Any disputes in connection with or arising from the Vitality Points awarded must be notified to us as soon as possible and in any event, within 30 (thirty) days from the date of activity, by contacting AIA Customer Care Line at 1500 980 or (021) 3000 1980 or by email to id.customer@aia.com. We may need you to provide us with supporting documents wherever applicable to assist us in settling any disputes. If we do not receive any notifications from you within the stipulated time frame of any disputes or inaccuracies on your Vitality Points, the Vitality Points statement will be taken to be correct, final and binding on you. Our decision on any such dispute shall be final and conclusive.

Vitality Programme is administered, managed and distributed in Indonesia by PT AIA FINANCIAL (a member of the AIA group of companies). PT AIA FINANCIAL shall receive ongoing support from Discovery, the global operator of the Vitality Programme.
By applying and participating in the Vitality Programme, you will be deemed to have:
(i) Read and agreed to be bound by the Terms and Conditions;
(ii) Consented to the collection, use (including without limitation, handling and processing) and disclosure of your personal information and Vitality Data in accordance with the Vitality Programme Privacy Statement;
(iii) Acknowledged and agreed that PT AIA FINANCIAL may make changes, interpret, implement, apply and/or exclude some or all of the Terms and Conditions; and
(iv) Agreed to be bound by the Terms and Conditions and any other rules, regulations, policies or procedures that may be adopted, promulgated, implemented, modified or varied by PT AIA FINANCIAL from time to time.
The Terms and Conditions apply to the Vitality Programme in Indonesia, and shall be binding on you and the Policy Owner(s) in your participation in the Vitality Programme.
You and the Policy Owner(s) must read the Terms and Conditions and provide your consent during the application process of Vitality Integrated Policy in order to participate in the Vitality Programme.
The Terms and Conditions are available on the AIA Vitality App and will also be mailed to Policy Holder along with insurance policy. We recommend that you periodically check these Terms and Conditions, the AIA Vitality App Terms of Use, the applicable Vitality Programme Privacy Statement and the Vitality Programme Benefit Guides on the AIA Vitality App. The date of these Terms and Conditions can be found at the bottom of this page under the heading ‘Last Updated’. You must read Terms and Conditions and give consent in AIA Vitality App before you activate your Vitality Programme membership.
Your participation in the Vitality Programme is voluntary. If you have any questions about the Terms and Conditions or wish to stop participating in the Vitality Programme at any time, please contact AIA Customer Care Line at 1500 980 or (021) 3000 1980 or by email to id.customer@aia.com. Our representatives will be happy to assist you.

Validity and expiry of Vitality Points

Vitality Points earned will expire at the end of the Vitality Programme Membership Year. Vitality Points may not be carried over into the subsequent year, your Vitality Points will be reset to 0 (zero) and your Vitality Status will be reset to bronze on your Vitality Programme Membership Year anniversary.
Vitality Points earned nearing the end of Vitality Programme Membership Year must be claimed within 30 (thirty) days from the end of the current Vitality Programme Membership Year. If you do not redeem the Vitality Points within this period, the Vitality Points will not be carried over into the subsequent Vitality Programme Membership year.
Please refer to Section 7.1 (Vitality Status) regarding Vitality Status used for reference to determine your Partner Benefits.

Transfer of rights

The Vitality Programme membership is personal to you and will not be assigned at law or in equity. Accrued Vitality Points do not constitute your property.
Vitality Points generated under this Vitality Programme apply to qualified benefits offered by the Partners in Indonesia only. They are not transferable to other Vitality Programme schemes operated elsewhere in the world (and vice versa).
Except as provided otherwise in these Terms and Conditions and/or in any other documents relating to Vitality Programme, you cannot transfer, assign, sell, barter or pledge your Vitality Points, your Vitality Status, Vitality Programme membership rights or rights to Programme Benefits and/or Partner Benefits, or Vitality Points to another person or another membership. Vitality Points cannot be bequeathed or devised. Vitality Points cannot be redeemed for cash and cannot be returned for any other consideration.
If Vitality Points or Partner Benefits are purchased from an unauthorized source, such transactions are voidable, and you will be liable for the full, unrestricted value of awards issued as a result of improper or fraudulent transfers and/or redemptions and otherwise in violation of the Terms and Conditions.

Membership Fee

Participation and membership in the Vitality Programme are subject to the payment of a Membership Fee.
The Membership Fee of the Vitality Programme is Rp. 50.000 (fifty thousand Rupiah) per month for 1 (one) Life Insured.
The Membership Fee for the subsequent years shall be advised to you and the Policy Owner prior to the Membership Fee Due Date. We reserve the right to vary the Membership Fee provided we notify you in advance of the new Membership Fee prior to the Membership Fee Due Date. If you have any objections with the revised Membership Fee amount, you may terminate your Vitality Programme membership in accordance with Section 10 (Termination of Membership) in the Terms and Conditions.
In case you become the Life Insured of more than one Vitality Integrated Policy, the Membership Fee shall attach to the first effective Vitality Integrated Policy purchased by you, and such Vitality Integrated Policy shall be designated the reference policy in connection with the Vitality Programme membership of the Life Insured.
The Policy Owner of the Vitality Integrated Policy registered designated as the reference policy for Vitality Programme, must pay the Membership Fee, in accordance with the following conditions: -
A. Membership Fee shall be paid together with your Vitality Integrated Policy premiums;
B. Membership Fee payment period will be the same periodic basis as your Vitality Integrated Policy premiums. Membership Fee payment period will be automatically changed, if Policy Owner propose changes on premium payment period in alignment with Policy Provision;
C. Membership Fee shall use the same currency as your Vitality Integrated Policy designated as the reference policy for Vitality Programme of the Life Insured;
D. Membership Fee is not part of policy premium and therefore shall not be charged to the Vitality Integrated Policy’s Fund Value;
E. The premium billing sent to Policy Owner consists of policy premium and Membership Fee; dan
F. Membership Fee need to be paid as long as Vitality Integrated Policy remains in-force.
If we do not receive payment of your Membership Fee by the end of the Grace Period, your Vitality Programme membership will be automatically terminated. Your Vitality Programme membership, Vitality Points and Vitality Status will remain in force during the Grace Period.

Transfer of the Vitality Programme Reference Policy

The Membership Fee charged to a Vitality Integrated Policy designated as the reference policy for Vitality Programme of the Life Insured, can be transferred to another Vitality Integrated Policy of the main Life Insured, by:
i. sending us a consent from the existing Policy Owner of the Vitality Integrated Policy designated as the reference policy and consent from Policy Owner of the Vitality Integrated Policy that will become the new reference policy; and
ii. paying the Membership Fee from the latest Membership Fee Due Date until the next Membership Fee Due Date under the new Vitality Integrated Policy.
Should you and/or the Policy Owner(s) fail to inform us upon the changes, PT AIA FINANCIAL may disregard the change and remains to refer to existing data.

Subject to our rules and any extension that may be allowed by us, your Vitality Programme membership will be automatically terminated and thereby all Vitality Points accumulated by you will be forfeited if: -
1) you are no longer the main Life Insured under an in-force Vitality Integrated Policy; or
2) we do not receive payment of your Membership Fee by the end of the Grace Period.
There will be no full or partial refund of the paid Membership Fee upon automatic termination of your Vitality Programme membership.

Termination of Vitality Programme membership by you

You may terminate the Vitality Programme membership and receive a full refund of the Membership Fee paid, only if:
A. You and/or the Policy Owner cancel the submission of the Vitality Programme membership prior to your Vitality Integrated Policy being issued; or
B. You and/or the Policy Owner cancel the Vitality Programme membership and/or your Vitality Integrated Policy during the Free Look Period.
The refund mechanism of the Membership Fee that has been paid shall be in accordance with the Vitality Programme Provision.
You may terminate your Vitality Programme membership by sending a written notice to AIA Customer Care Line via email to id.customer@aia.com. In circumstances other than as aforementioned in this section, there will be no full or partial refund of the Membership Fee paid by you should you choose to terminate your Vitality Programme membership.
Upon termination of your Vitality Programme membership, you have the option to terminate your existing relationship with the Partners. Should you choose to retain your relationship with such Partners, you will be subject to the relevant terms and conditions of such Partners.

We reserve the right to terminate, suspend, cancel, deactivate, recall or revoke the Vitality Programme (in whole or in part) at any time and do not guarantee that the Vitality Programme will continue indefinitely or that it will be managed and owned by us.
We further reserve the right to terminate, suspend or deactivate your Vitality Programme membership (in whole or in part, including your access and right to utilize the Vitality Programme Benefits), your transaction(s), Vitality Electronic Membership Card, Vitality Points and/or forfeit the accumulated Vitality Points, for reasons which include, but are not limited to the following:
A. if we detect or suspect any unusual, irregular, suspicious, fraudulent or unauthorized use or activity or any conduct/misconduct;
B. if your actions are detrimental to the interests of PT AIA FINANCIAL, or in the event any threatened and/or actual breach by you of these Terms and Conditions;
C. if you do not or no longer qualify (or we suspect that you do not or no longer qualify) for the Vitality Programme membership under these Terms and Conditions;
D. if you do not pay the Membership Fee or any other fees payable to us and/or any of our Partners, or fail to pay such fees beyond the Grace Period granted by us;
E. if we detect or suspect that you are abusing or misusing the Vitality Programme and its Partner Benefits and/or Programme Benefits, Vitality Points or privileges of the Vitality Programme membership;
F. if you are no longer a main Life Insured of a Vitality Integrated Policy to which the Vitality Programme membership is linked;
G. in the event of a claim which causes the underlying Vitality Integrated Policy to cease involuntarily (matured) and there is no longer an in-force Vitality Integrated Policy to link the Vitality Programme membership to;
H. in the event of the demise of a main Life Insured of a Vitality Integrated Insurance Policy; and/or
I. where the Vitality Integrated Policy cancellation, applies to either an in-force policy cancellation or a policy cancellation during the free look period, and there is no longer an in-force Vitality Integrated Policy to link the Vitality Programme membership to.
We shall notify you of the termination or cancellation of the Vitality Programme or the termination or cancellation of your Vitality Programme membership via Correspondence.
In the event the Vitality Programme is terminated as stated in Section 10.3, the Membership Fee will not be refunded, with exception of the event of the demise of a Life Insured of a Vitality Integrated Insurance Policy in accordance with Section 10.3(H) above, we will refund the unused membership period of the Membership Fee.
The refund mechanism of Membership Fee will refer to the applicable Vitality Programme Provision.
Subject to the terms of our agreement with the relevant Partners or any other terms imposed by the relevant Partners and at our sole discretion, we may allow Vitality Programme Members to access their Partner Benefits redeemed or ordered prior to the date of termination or cancellation of the Vitality Programme or the Vitality Programme membership.

Consequences of termination of your Vitality Programme membership

If your membership is terminated for any reason:
A. your rights to Partner Benefits and/or Programme Benefits will be ceased and forfeited upon the termination of your Vitality Programme membership, subject to the terms of our agreements with the relevant Partners, and any other terms imposed by the relevant Partners; and
B. any Vitality Points accumulated and Vitality Status achieved will be cancelled and forfeited upon the termination of your Vitality Programme membership.

11. Reinstatement and reactivation of Vitality Programme membership status

Description
If the Life Insured is an Inactive Member, the Policy Owner can reinstate or reactivate the Vitality Programme membership status, as long as the Vitality Integrated Policy remains in-force.
The procedure for reinstating the Vitality Programme membership status as an Active Member are as follows:
a. The Policy Owner must apply for their Vitality Programme membership status reinstatement to us to become an Active Member; Membership status reinstatement can only be processed if you become an Inactive Member for less than 2 (two) years;
b. Any outstanding Membership Fee since becoming an Inactive Member must be paid;
c. We may automatically reinstate your Vitality Programme membership status as an Active Member without requiring any reinstatement application by you, if we receive all outstanding Membership Fees within 120 (one hundred and twenty) days since you are becoming an Inactive Member;
d. Any Programme Benefits accrued prior to reinstatement (if any) will be paid to the Policy Owner after becoming reinstated as an Active Member; and
e. Upon successful membership status reinstatement, the Members Vitality Status will determine in accordance with Section 7.5 (Validity and Expiry of Vitality Points).
The procedure for reactivating the Vitality Programme membership status to become an Active Member are as follows:
a. The Policy Owner must submit their Vitality Programme membership status reactivation to us to become an Active Member;
b. Reactivation of the Vitality Programme membership status can be done by paying Membership Fees starting the reactivation date;
c. The Policy Owner and Life Insured will not be entitled to any Programme Benefits and/or Partner Benefits accrued prior to reactivation (if any);
d. Vitality Status will be reset to the new Status after reactivation date; and
e. Vitality Programme Effective Date shall be readjusted to the reactivation date.
The Vitality Programme membership status reinstatement or reactivation application must be submitted to us with the following documents:
i. A completed Vitality Programme Membership Reinstatement/Reactivation Application Form and signed by the Policy Owner;
ii. A copy of the Policy Owner and Life Insured’s valid National ID (KTP for Indonesians or passport for foreign nationals);
iii. Payment receipt of Membership Fee; and
iv. Other documents deemed necessary by us in connection with the Vitality Programme reinstatement or reactivation request.
We have the sole right to approve or reject the reinstatement or reactivation request of the Vitality Programme membership.
Calculation of the outstanding Membership Fee in relation to reinstatement or reactivation will be subject to our determination.

Changes to the Vitality Programme, Partners and Vitality Programme Benefits

It is your responsibility to keep yourself up to date in respect of the Vitality Programme, including the applicable Terms and Conditions published on the AIA Vitality App.
PT AIA FINANCIAL reserves the right to change or vary the Vitality Programme, including but not limited to:
A. Changing the ways in which Vitality Points and Vitality Status levels are earned, credited, accumulated or structured;
B. Changing the number of Vitality Points required to access or use a Partner Benefit and/or a Programme Benefit;
C. Changing the ways in which Partner Benefits may be redeemed and/or a Programme Benefit may be attained;
D. Adding, limiting, changing, replacing or removing Partners;
E. Adding, limiting, changing, replacing, cancelling, withdrawing or removing any Partner Benefit and/or Programme Benefit, incentive or cash back;
F. Changing the Membership Fee;
G. Changing any other features, concessions or Partner Benefits and/or Programme Benefit of the Vitality Programme; and/or
H. Adopting or implementing any legal requirements, decisions, recommendations, regulatory guidance or judgments of any court, tribunal, ombudsman service or regulator.
We will publish any changes or variations to the Vitality Programme on the AIA Vitality App at least 14 (fourteen) days prior to the effective date of the revision. If we consider the changes are significant, we shall notify you and Policy Owner(s) in advance by Correspondence.

Membership of the Vitality Programme does not give rise to any legal relationship with PT AIA FINANCIAL, other than being bound by the Terms and Conditions.
Nothing herein shall be construed as a representation by us that Vitality Programme and/or Vitality Electronic Membership Card is/are available for use in geographic areas or jurisdictions other than Indonesia.
If for any reason, any provision or part of the Terms and Conditions is found to be void or unenforceable, such provision or part of the Terms and Conditions shall be deemed to be severed from the Terms and Conditions, and the remainder of such provision or part of the Terms and Conditions, shall remain in full force and effect and may be enforced to the fullest extent possible.
We and our Partners may from time to time offer other benefit promotions, special discounts, competitions, exclusive offers, etc. via Correspondence.

We collect Vitality Data and other personal and sensitive information in a range of circumstances, including on registration, when you contact us, make an enquiry or use or request our products or services or the products or services of our Partners. The types of Vitality Data and other personal and sensitive information we collect includes but is not limited to personal metrics such as calories burned, step count, heart rate, sleep patterns, your name and contact details, identifying information (e.g. date of birth), demographic and profile information (sex, age, etc.), and health and medical-related information. We also collect personal information about your interactions with us, including any contact we have with you by telephone, email or online. You hereby agree that any information provided by you for use in relation to the Vitality Programme is on a voluntary basis for your membership and participation in the Vitality Programme.
By agreeing to participate in the Vitality Programme, you agree to the collection, use, sharing, and disclosure of your Vitality Data and other personal and sensitive information by us and our service providers as reasonably necessary to administer the Vitality Programme.
Your subscription of the Vitality Programme membership and certain information may be disclosed by us to those persons who have an insurable interest on your life (i.e. Policy Owners or applicants of insurance policy under which you are named as the Life Insured). We may grant access to the servicing agents of these Vitality Integrated Policy under which you are named as the Life Insured in order to provide proper advice and service to the Policy Owner or applicants under which you are named as Life Insured with respect to Vitality Integrated Policy.
Any health or medical-related personal information you provide as part of your AIA Vitality membership will not be provided to the underwriting or claims departments of PT AIA FINANCIAL and therefore will not be used in the making of any future underwriting or claims decisions.
In accordance with your duty of disclosure, you are still therefore obliged to disclose any of this information to the extent it may be relevant in the event of any future application for insurance cover, changes to existing insurance cover or claims under an insurance policy with PT AIA FINANCIAL.

Dishonesty / fraud / misrepresentation / abuse of Vitality Programme privilege

Your membership of and participation in the Vitality Programme is based on mutual trust. Where dishonesty or fraud or misrepresentation or abuse of the Vitality Programme is detected, Programme Benefits and/or Partner Benefits may not be awarded, your Vitality Programme membership may be cancelled or terminated, and we may take any other actions as may be necessary in accordance with our legal rights.
If any act or omission by you is dishonest or fraudulent or constitutes an abuse of the Vitality Programme, or if any dishonest or fraudulent or improper means or devices are used by you or anyone acting on your behalf in relation to the Vitality Programme, we have the right to:
a. Refuse access to the Programme Benefits and/or other Partner Benefits under the Vitality Programme;
b. Cancel, forfeit and withdraw all Vitality Programme Benefits which has already been paid and/or given to you and/or Policy Owner and/or anyone acting on your and/or Policy Owner’s behalf, in this case including but not limited to: -
i. withdrawing Programme Benefits in the Policy Fund Value paid by us; and/or
ii. withdraw any voucher or other Partner Benefits which has already redeemed in the AIA Vitality App and/or paid and/or provided by us, or any of our Partners (or by any other party under our direction); dan
c. Terminate your Vitality Programme membership.

Exclusion of liabilities

Under no circumstances shall PT AIA FINANCIAL be liable for any loss or damage of any nature, including as a result of its negligent acts or omissions or those of its officers, employees, directors, agents, advisers, contractors, Partners or any other persons for whom in law it may be liable, which you, your beneficiaries or any third parties may sustain as a result of engagement in the Vitality Programme. By agreeing to these Terms and Conditions you, your beneficiaries and any third parties agree to indemnify and hold harmless PT AIA FINANCIAL for any loss or damage of any nature accordingly.
All liability of PT AIA FINANCIAL and their respective officers, employees, directors, agents, advisers and/or contractors of PT AIA FINANCIAL and/or Partners for any loss, damage, claim or expense (including but not limited to indirect, incidental, special, punitive or consequential liability, economic loss, loss of profits and loss of opportunity) you may incur or suffer that arises directly or indirectly out of these Terms and Conditions, any other governing documentation as set out in Section 1 (Governing Documentation and Membership Conditions) of these Terms and Conditions or the Vitality Programme (regardless of whether we have any control over circumstances giving rise to the claim or not) including termination or suspension of your Vitality Programme membership, termination of the Vitality Programme and/or termination of any Vitality Programme Benefits, is hereby excluded. This applies even if we have been informed that the liability, loss, damage or expense will or may result. PT AIA FINANCIAL and/or Partners and their respective officers, employees, directors, agents, advisers and/or contractors of PT AIA FINANCIAL disclaim all warranties, express or implied, in connection with the Vitality Programme and the Vitality Programme Benefits. If PT AIA FINANCIAL and/or Partners are liable to you in any way, you agree that our liability shall be limited to Vitality Points and Vitality Status allocations to your Vitality Programme membership which you accept is appropriate.
PT AIA FINANCIAL disclaims all express or implied warranties including, but not limited to, warranties of availability, price, satisfactory quality, merchantability and fitness for a particular purpose.
PT AIA FINANCIAL shall not be liable for any disruption to the Vitality Programme or any delay to or inability to provide any of the benefits caused by circumstances beyond the control of PT AIA FINANCIAL including, but not limited to, failure of any service provider or other third party, merchant closure, strikes or industrial disputes, acts of God, flood, weather, natural disaster, unavailability, war, hostilities (whether war be declared or not) terrorism, rebellion, revolution, insurrection, military or usurped power or confiscation or civil disturbance.
Any third-party links (including those of Partners) provided by us on any of our Websites, mobile app, communication channels and social media are provided for your convenience. Their inclusion does not imply any approval or endorsement by us. We have no control over the content of those sites and accept no responsibility or liability in respect of them.
You must evaluate and bear all risks associated with the use of the content downloaded and acquired through our Websites or third party (including partner) websites. We shall not be liable for any damage or loss of any kind directly or indirectly arising from or in connection with your use or inability to access our Websites or third party (including partner) websites and/or use any related documents. Please note that the material (including, without limitation, workout and exercise tips, and information contained in applications and video clips), provided on any of our Websites, mobile app, communication channels and social media, including all text, photographs, images, illustrations, graphics, audio, video and audio-video clips, is provided by way of general information only. You expressly agree that your athletic activities carry certain inherent and significant risks of property damage, bodily injury or death and that you voluntarily assume all known and unknown risks associated with these activities even if caused in whole or part by the action, inaction or negligence of us or by the action, inaction or negligence of others (including Partners). You also expressly agree that we do not assume responsibility for the inspection, supervision, preparation, or conduct of any race, contest, group athletic activity or event that may earn you Vitality Points.
If you ever start to feel unwell or have discomfort at any time after trying the workout or exercise, stop immediately and seek further advice from your healthcare professionals. Do not disregard, avoid or delay obtaining medical or health related advice from your healthcare professional because of what you may have read on any of our website, mobile app, communication channels and social media. Current health and fitness research may exist that could impact the information provided by us; information provided may not be based on the most recent findings or developments. We shall not be held responsible for any injuries and/or damages that may result from your participation in or engagement of the workout or exercise or any health and wellness programme, of which the information has been provided to or shared with you on any of our Websites, mobile app, communication channels and social media.
We do not accept any liability with respect to death, injury or any consequential damage or loss arising from or in connection with the Vitality Programme generally or from the supply of a benefit or service or from the loss, theft or destruction of a Partner Benefit and/or Programme Benefit (including, but not limited to vouchers).
You may incur a tax liability or disclosure obligation through joining or use of Vitality Programme. You should obtain your own financial or tax advice regarding any benefits you may receive through the Vitality Programme. PT AIA FINANCIAL is not liable for any financial or tax consequences that may arise in connection with the Vitality Programme or your Vitality Programme membership. PT AIA FINANCIAL reserves the right to provide any tax authorities with full details of any Vitality Programme Member’s accrual and redemption of Partner Benefit and/or Programme Benefits, upon request of a tax authority. PT AIA FINANCIAL excludes all liability for cooperating with such tax authorities in this manner.

Law and jurisdiction

These Terms and Conditions and the relationship between you and PT AIA FINANCIAL are governed by the laws of Indonesia. By joining the Vitality Programme, you agree to submit to the exclusive jurisdiction of the South Jakarta District Court.
Should any conflict arise between the Bahasa Indonesia language version of these Conditions of Use and the English version hereof, the Bahasa Indonesia version shall prevail. In the event of any dispute, PT AIA FINANCIAL reserves the right of final decision.
Should any discrepancies or conflict arise between the terms governed in Vitality Programme Terms of Conditions, Terms of Use of AIA Vitality App, Vitality Programme Privacy Statement, Vitality Programme Benefit Guides, and other rules related to Vitality Programme, PT AIA FINANCIAL reserves the right to determine the prevailing rules within a reasonable endeavour.

PT AIA FINANCIAL may accept or refuse membership to any applicant of Vitality Programme in its sole discretion.
You are eligible to apply for the Vitality Programme membership if: -
You are named as the main Life Insured under a Vitality Integrated Policy. Your Vitality Programme membership will be effective upon the inception of your Vitality Program Effective Date. As a Member, you can access the AIA Vitality App and enjoy the Partner Benefits in the AIA Vitality App.
Vitality Programme membership is renewed on an annual basis. Please refer to Section 8 (Membership Fee) for more details about the Vitality Programme Membership Fee, billing and payment information.

Qualification as a Vitality Programme Member

To be qualified as a Vitality Programme member, an applicant should meet the following requirements: -
A. You must be 18 years or older by the time of application, whereas the maximum issue age is based on the underlying policy of the Vitality Integrated Policy; and
B. You must be the current main Life Insured of a Vitality Integrated Policy; and
C. The Membership Fee must be duly paid.
Your participation in the Vitality Programme will require your Vitality Integrated Policy to be in force. Your existing policy(s) and underwriting will not be impacted by your participation in the Vitality Programme, other than obtaining Vitality Programme Benefits such as premium discounts, cashbacks or other benefits on Vitality Integrated Policy based on your Vitality Data or other information about you including whether you have successfully achieved the Vitality Programme targets within the required timeframes.
The Vitality Programme Member must be a natural person (i.e. an individual). Each individual is entitled to only one active Vitality Programme membership in Indonesia. Standalone purchase of the Vitality Programme membership without Vitality Integrated Policy is not allowed.

Vitality Electronic Membership Card

Each Member will be issued with a membership number and a Vitality Electronic Membership Card. The use of this number/card or associated benefits shall be subject to the Terms and Conditions and any other applicable rules, regulations, policies or procedures related to the Partner Benefits provided by PT AIA FINANCIAL and/or our Partners.
You will receive your Vitality Electronic Membership Card upon the issuance of your Vitality Integrated Policy and upon your successful activation of your Vitality Programme membership. You will be able to find your Vitality Electronic Membership Card within your AIA Vitality App under the e-Card feature. PT AIA FINANCIAL shall not be responsible for any mistake or error in your Vitality Programme application.
You may need to present your Vitality Electronic Membership Card and/or your Vitality membership number at our Partners to earn Vitality Points and enjoy Partner Benefits. If you fail to present your Vitality Electronic Membership Card at our Partners when requested, you may not be able to claim such Vitality Points and the Partner Benefits respectively.
Vitality Programme membership and Vitality Electronic Membership Card are non-transferable and non-assignable and must be used exclusively only by you. You will remain liable for all transactions incurred from usage of the Vitality Electronic Membership Card (whether authorized or otherwise).
PT AIA FINANCIAL is entitled, but not obliged, to rely on all instructions and transactions carried out using your Vitality Electronic Membership Card under your username and password. You will not be entitled to dispute any transaction using your Vitality Electronic Membership Card under your username and password, unless PT AIA FINANCIAL has previously blocked it based on your request or our discretion on the suspected or actual unauthorized use.
By applying for and using the Vitality Electronic Membership Card, you agree and undertake:
A. to use the Vitality Electronic Membership Card in accordance with the Terms and Conditions, and not to use the Vitality Electronic Membership Card for any commercial, fraudulent or unlawful purposes or any other purposes which may be deemed unacceptable by PT AIA FINANCIAL or which are prohibited by the Terms and Conditions;
B. to promptly notify PT AIA FINANCIAL of any unauthorized use, loss or theft your mobile device that contains your Vitality Electronic Membership Card;
C. to change your password immediately and notify PT AIA FINANCIAL immediately if you have reason to suspect that the security and/or confidentiality of your password has been compromised; and
D. to pay all fees relating to the use of your Vitality Electronic Membership Card as determined by PT AIA FINANCIAL and/or our Partners.

The Vitality Programme is a health and wellness programme that aims to motivate you to be proactive about improving your health and general well-being by providing Vitality Points and various Partner Benefits which may include discounts, exclusive offers, voucher and other benefits relating to goods and/or services offered by PT AIA FINANCIAL and our Partners from time to time.
Unless otherwise set out in the relevant Vitality Programme Benefit Guide, only a Member can enjoy the Partner Benefits.
Certain Partner Benefits may not be accessible immediately and may be subject to a processing or waiting period. The Vitality Program Benefit Guide will explain when such Partner Benefits will be available and the relevant terms and conditions applicable to obtaining Vitality Points and/or Partner Benefits. If you do not activate your Vitality Programme membership, you will not be able to be awarded Vitality Points and/or access the Partner Benefits.
